Late Payments of Commercial Debts (Interest) Act 1998
by jonbowes at 10:00 01/09/04 (Shout99)
My company recently rented a flat whilst servicing a contract in Swindon. All the services etc have now been settled excpeting the council tax. Can I use the Late Payment of Commercial Debt legislation to chase for the repayment of overpaid council tax...?
Hi Guys

Although I sent Swindon Borough Coucil a letter dated 23 June informing them that I was vacating the property on the 30 June and that they should adjust my liability accordingly. It is now 25 August and I am still waiting for a response let alone a cheque.

As the flat was rented by my company directly and the council tax had been paid directly from the companies bank account can I now invoke the Late Payment of Commercial Debts (Interest) Act 1998 to recover the debt plus interset and cost element from Swindon Borough Council...?

I have used the act before with clinets with good results....

Regards

Jon
