Payment for loss of employment rights

The tories have suggested several times that you might be paid extra if you're prepared to lose your employment rights(paternity leave etc).

Q. If a contract has been jugged by HMRC as being subject to IR35 ie you pay as an employed person, since its HMRC have judged you does that mean that HMRC would have to pay for the lost of your employment rights?
