CIPD Advice on IR35

I've just stumbled on a CIPD article raising concerns about IR35, titled "HMRC vows to crack down on use of freelance staff".

Have I missed a rewrite of IR35 or does the CIPD have IR35 completely upside down?

This article talks of recruiting organisations being fined by HMRC for breaching IR35 tax laws. Surely the whole 15 year fight over IR35 has been between HMRC and companies providing a service. It has nothing to do with the organisation engaging the services of a limited company. How would the engaging company even know how much the service company is paying it's employee/employees?

I don't particularly care if the CIPD don't understand IR35 but surely, advice like this to potential client companies is going to kill off the entire freelance industry!

If I'm the one who doesn't understand IR35, I apologise and can someone please put me straight.
