Protecting Pension Scheme
by janefun at 11:57 11/12/17 (Ask-Legal-Accounting)
I hope someone can offer an opinion on how to protect my pension scheme. I am currently dissolving my limited company through which I worked and contributed to a pension scheme for about 20 years.
I have been told by my pension company the pension is not a company pension scheme but an occupational pension held in my own and my husband's names. For this reason they have said it cannot be passed to the Crown under the Bona Vacantia rules. I feel uncertain about whether this could happen because I read on the Treasury Solicitor's website that their rules also apply to occupational pensions. How likely is it that this could happen to my pension, and, if so, how can I avoid this? All the pension company have done is issue me with a Deed of Assignment. Will completing this before submitting the DS01 protect us?
