The minutes from the latest IR35 Forum show two issues which will impact on freelancers. First HMRC has explained its more 'focused' approach on IR35 enforcement with the creation of three specialist units. This has already led to an increase in the number of reviews taken up by HMRC.
Secondly, 'that' question on the P35 relating to whether you are a 'service company' and your IR35 position, will be merged into one question, supported by a legal requirement to answer it. Already the experts have started debating the implications.

And the controversial business entity tests have appeared in another arena for contractors. A leaked document from the Treasury appears to show that these tests are to be used as one of the yard-sticks to determine IR35 status for the controversial 'off payroll' status for Government contractors.
