Referring now to the timing of the winding up process, relative to the claiming back of the corporation tax paid in previous years.
As the ltd.co. is in a loss situation. it owes the director for unpaid expenses.
Should the corp.tax not be reclaimed first, and then repaid to the director as part of the overdue expenses; before the winding up process is even commenced?
Otherwise, during the period of winding up. any corp. tax repayment awarded to the company during that period, might be counted towards the company assets and would thus become eligible to be appropriated by the HMRC during the winding up process?
In the latter event, no part of the unpaid expenses could be repaid.
