Contractual exclusion clause

Is this particular clause legal?
This is the clause from the contract, company obfuscated for obvious reasons:

11.3The Operative as named in the contract confirmation note will not be able to return
to the client or its customers where the Operative has previously worked for a
period of 12 months, unless a contract is agreed with the Company (##########) prior
to the commencement of the work. If the Operative starts without prior
arrangement a fee equal to 6 months charge (based on the Operative’s last contract
with the Client) will become payable to the Company (#########) by the Operative.
