Thank you for purchasing FO35, Freelancers outside IR35, which includes the Tax Enquiry Fees and Penalty Protection insurance policy, which is managed by Qdos Consulting Limited. This document provides a summary of the cover under that policy. The certificate of insurance and full policy wording is held by Shout99 and is available upon request.

Summary of Cover

The Policy is underwritten by Groupama Insurance Company Limited,

The insured will be covered for professional fees and penalties incurred up to a limit of £50,000 in respect of the following:

-

An Inland Revenue Aspect Enquiry (unless specifically excluded)

- An Inland Revenue Full Enquiry
-

An Inland Revenue Special Compliance Office Enquiry or Investigation (£5,000 Indemnity Limit - provided that it is proved that the Insured was not found guilty of any fraud or fraudulent intent)

A VAT Dispute

-

A PAYE/NIC Dispute

-

An IR35 Dispute (up to Appeal subject to prospects of success Definition of prospects of success)

-

Compensation against penalties relating to the disputes and investigations listed above.

The scheme will include the costs relating to dealing with correspondence, preparing documents and reports, attending meetings and, if required, hearings and tribunals. If appropriate the underwriters will also meet the cost of an appeal against the decision of a Commissioners' Hearing or VAT Tribunal.

The principal exclusions to the policy are as follows:

-

Claims resulting from enquiries or visits which commenced prior to the commencement of the policy

- Claims resulting from accounts, tax or VAT returns having been submitted late without good reason
-

Matters where the revenue authority allege fraudulent evasion of tax or VAT and pursue the case on that basis or where the insured person has acted dishonestly in respect of the accounts and returns rendered.

Any enquiry arising from using a Tax Avoidance Scheme which has not been agreed in writing by Insurers prior to its adoption.

The period of cover is one calendar year from the date of inception and is renewable annually.

You must immediately notify Qdos Consulting Limited in the event of a claim or circumstance which might be covered under this policy. Failure to notify immediately may result in Underwriters being prejudiced and any such claim may be reduced or rejected.
