The details relating to the controversial off-payroll legislation have revealed the surprise that the responsibility for deciding if IR35 applies will be with the client or 'end-user'. And it was confirmed that the responsibility for paying the tax if IR35 does apply will be with the agency or the third-party who pays the contractor.
